The withdrawal of the lawsuit followed intense political and social controversy surrounding the so-called “joint custody reform amendment.” This regulation, which was incorporated into a bill and approved by a broad majority, stipulates that if conditions change after a first-instance decision on parental care, the same court may, upon application by a parent, relatives, or the prosecutor, temporarily modify the decision until an appeal ruling is issued. In simpler terms, it introduces the possibility of a “reform lawsuit,” ensuring that a custody arrangement does not remain rigid when the actual living conditions of children or parents have fundamentally changed.
