The Council of State said “yes” to the draft presidential decree concerning the approval of the Special Environmental Equivalent Urban Upgrade Plan (EESPIAP) for offsetting the use of New Building Code incentives. The draft PD had been submitted to the 5th Section of the Council of State for legislative review following the decisions of the Plenary of the Supreme Administrative Court (146, 147, 148, 149/2025).
Finally, the 5th Section of the Council of State with decision No. 135/2025 (which will be published in the coming period) ruled the presidential decree in question as legal and constitutional. The State Councilors determined – according to sources – that the draft PD aligns with the spirit of the Plenary decisions of the Council of State. According to reports, they emphasize that before issuing a building permit, pre-screening is required, while simultaneously determining the amount of environmental equivalent, the procedure, and those liable for payment. This amount will be paid into a special account at the Deposits and Loans Fund and will be allocated exclusively to the entitled municipality for implementing environmental equivalent actions.
